These Terms govern your use of afirmlabs.com (the "Site"), operated by Afirm Labs Inc. ("Afirm Labs," "we," "us"), a Delaware corporation with offices at 305 E Huntland Drive, Ste 500, Austin, Texas 78752.

By using the Site, you agree to these Terms. If you don't agree, please don't use the Site.

1. What the Site Is

The Site is an informational website about our services. It lets you learn what we do and contact us.

• Send us anything through the contact form that is unlawful, abusive, or infringes someone else's rights

• Misrepresent who you are

4. Our Content

The Site and its contents — text, design, graphics, code, logos, and the Afirm Labs name and marks — are owned by us or our licensors and protected by intellectual property laws.

You may view and share the Site for your own informational and non-commercial use. Everything else requires our written permission.

5. What You Send Us

If you send us a message, question, idea, or feedback through the Site or by email, you grant us a non-exclusive, royalty-free, worldwide license to use it for any purpose, including improving our services. We will treat any personal information in it as described in our Privacy Policy.

Please don't send us confidential information through the Site. Unless we've signed an NDA with you, nothing you send us is confidential, and we're not obligated to keep it secret or to refrain from developing similar ideas independently.

The Site may link elsewhere. We don't control those sites and aren't responsible for their content, products, or practices.

THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE SPECIFICALLY DISCLAIM THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We don't warrant that the Site will be uninterrupted, error-free, or secure, or that the information on it is complete or current. Content on the Site is general information, not professional advice.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SITE.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100).

These limits don't apply to liability that cannot be limited under applicable law, including our own gross negligence, willful misconduct, or fraud. Some jurisdictions don't allow certain limitations, so parts of this section may not apply to you.

We may suspend or restrict your access to the Site at any time, for any reason, without notice. Sections 4, 5, 7, 8, 9, and 11 survive any termination.

11. Governing Law and Disputes

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules.

Any dispute will be brought exclusively in the state or federal courts located in Travis County, Texas, and you and we each consent to the personal jurisdiction of those courts.

12. Changes

We may update these Terms. We'll update the date above and post the revised version here. Changes apply going forward; if you keep using the Site after we post them, you're accepting them.

13. General

If any provision of these Terms is unenforceable, the rest stays in effect. Our failure to enforce a provision isn't a waiver of it. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms, together with our Privacy Policy, are the entire agreement between you and us regarding the Site.
